1. Definitions
- "Retirely", "we", "us", "our" — Retirely, registered at 17 Jalan Kelawai, 10250 George Town, Pulau Pinang, Malaysia.
- "Service" — any administrative coordination or educational service provided by Retirely, including the Paperwork Health Walkthrough, the Retirement Records Course, and the Full Household Records Engagement.
- "Client", "you", "your" — the individual or household that engages Retirely.
- "Agreement" — these Terms & Conditions, together with any written scope letter or booking confirmation issued by Retirely.
- "Content" — all written materials, templates, workbooks and other documents produced by Retirely and provided to the Client.
2. Acceptance of Terms
By submitting an enquiry, making a booking or attending any session, you agree to be bound by these Terms & Conditions. Our services are available to individuals aged 18 and above who have the legal capacity to enter into a binding agreement under Malaysian law.
3. Nature of Our Services
Retirely provides administrative coordination and general education services only. This includes sorting, labelling, scanning, indexing and describing documents, and teaching general record-keeping principles.
Our services do not include and must not be relied upon as:
- Financial advice, investment advice or any advice regulated under Malaysian financial services law
- Legal advice, estate planning, will preparation or any service regulated under the Legal Profession Act
- Interpretation of entitlements under EPF, SOCSO, pension schemes or any other regulated scheme
- Acting as an agent or representative for the Client with any institution, government body or third party
Any question that falls within the above areas will be noted as an open item and referred to an appropriately qualified professional of the Client's choosing.
4. Booking and Confirmation
A booking is confirmed when Retirely issues a written scope letter or booking confirmation and the applicable fee is received in full (or a deposit agreed in writing). Course enrolment is confirmed on receipt of payment.
Session scheduling is by mutual agreement. Retirely will make reasonable efforts to accommodate preferred times but cannot commit to specific dates until written confirmation is issued.
5. Fees and Payment
- Paperwork Health Walkthrough: RM 470 per session, payable in full before the session.
- Retirement Records Course: RM 1,340 per participant, payable in full before the first session.
- Full Household Records Engagement: RM 4,480 total. A deposit of RM 1,120 is payable on confirmation; the balance of RM 3,360 is payable at the midpoint of the engagement (week 6).
All fees are in Malaysian Ringgit (MYR). Payment may be made by bank transfer or such other method as agreed in writing. Fees include all materials described in the scope letter but exclude any third-party costs (for example, external storage devices purchased on the Client's behalf).
6. Cancellation and Rescheduling
- Cancellations made 7 or more days before a booked session will receive a full refund.
- Cancellations made less than 7 days before a session will forfeit 50% of the session fee.
- Cancellations of a Course after the first session has taken place will receive a pro-rata refund for remaining sessions only.
- For a Full Household Engagement, the deposit is non-refundable if the Client cancels after the scoping visit has taken place.
- Retirely reserves the right to reschedule a session with at least 48 hours' notice. If Retirely cancels without adequate notice, a full refund will be issued.
7. Client Responsibilities
- Provide accurate information when making an enquiry or booking.
- Ensure that documents brought to or shared in a session belong to you or that you have authority to share them.
- Attend sessions at the agreed time, or provide at least 48 hours' notice of the need to reschedule.
- For the Full Household Engagement, ensure that a responsible adult is present or available during on-site sessions.
- Make independent enquiries to qualified professionals for any matters falling outside the administrative scope of our services.
8. Intellectual Property
All materials produced by Retirely — including workbooks, template packs, naming conventions and written handover maps — are provided to the Client for personal, non-commercial use. You may not reproduce, distribute or adapt these materials for commercial purposes without written consent from Retirely.
Course recordings are provided to enrolled participants for personal review only. Sharing or distributing recordings is not permitted.
9. Confidentiality
Retirely treats all documents and information shared during an engagement as confidential. We will not share, copy or disclose any materials or personal information outside the terms of our Privacy Policy and these Terms.
All original documents remain the property of the Client. No originals are removed from the session location without written consent.
10. Disclaimer
Our services are administrative in nature and are provided without any representation as to the completeness, accuracy or suitability of any outcome for the Client's particular regulated or financial circumstances.
We do not warrant that the administrative organisation of documents will produce any particular outcome in dealings with EPF, SOCSO, insurers, courts or any other institution. The Client remains responsible for all regulated decisions and for engaging qualified professionals where required.
11. Limitation of Liability
To the extent permitted by Malaysian law, Retirely's liability for any claim arising from the provision of our services is limited to the total fees paid by the Client for the specific engagement giving rise to the claim.
We are not liable for indirect, consequential or special damages, including but not limited to financial loss arising from decisions made on the basis of documents we have organised or summaries we have provided.
12. Governing Law and Disputes
These Terms are governed by the laws of Malaysia. Any dispute that cannot be resolved informally between the parties will be referred to the courts of Malaysia, with George Town, Penang as the agreed jurisdiction.
Before commencing any formal proceedings, both parties agree to attempt to resolve disputes through direct written communication over a period of at least 30 days.
13. Changes to These Terms
We may update these Terms from time to time. The current version is always available on our website. Continued use of our services after an update constitutes acceptance of the revised terms. For existing engagements, changes will not apply retroactively.
